Terms of Use for Resonali Voice Method

These Terms of Use govern access to and use of the Resonali Voice Method mobile application, developed and operated by Resonali LLC.
By downloading, purchasing, accessing, or using Resonali Voice Method, you agree to these Terms of Use. If you do not agree, do not use the app.
 
1. Purpose of the App
Resonali Voice Method provides guided voice exercises, educational content, awareness activities, reflective prompts, and structured voice-practice tools.
The app may include activities related to posture, breathing, phonation, resonance, vocal flexibility, coordination, carryover, tension awareness, and regulation.
Voice-related awareness, reflection, regulation, and counseling prompts are included as part of voice care and practice. They are not intended to provide psychotherapy or mental-health treatment.
 
2. Educational and Practice Resource
Resonali Voice Method is an educational and guided-practice resource.
The app does not provide an individualized clinical evaluation, medical diagnosis, treatment plan, prognosis, emergency service, or professional relationship between the user and Resonali LLC.
Use of the app does not establish a speech-language pathologist–patient, clinician–patient, physician–patient, therapist–client, or other healthcare-provider relationship.
The app is not a substitute for individualized evaluation, treatment, or advice from a licensed speech-language pathologist, physician, or other qualified healthcare professional.
 
3. Safety and Appropriate Use
Users are responsible for deciding whether an activity is appropriate for their individual needs, abilities, and health status.
Activities should be completed within an easy and supported range. Do not force the voice, breath, body, or range of motion.
Stop an activity and seek appropriate professional guidance if it causes or worsens:

• Pain or significant discomfort

• Dizziness or lightheadedness

• Shortness of breath or breathing difficulty

• Swallowing difficulty

• Persistent coughing or choking

• Sudden or concerning voice changes

• Significant vocal fatigue or strain

• Any other concerning symptom

Seek emergency medical care for urgent or severe symptoms.
 
Individuals with a known or suspected voice, breathing, swallowing, neurological, cardiac, respiratory, or other medical condition should consult an appropriate qualified professional regarding safe participation.
 
4. No Guaranteed Outcomes
Individual responses to voice exercises and practice vary.
Resonali LLC does not guarantee that use of the app will produce a particular clinical, vocal, functional, professional, or personal outcome.
 
Progress may depend on factors including individual health, diagnosis, anatomy, practice, technique, environment, and guidance from qualified professionals.
 
5. Adult Use
Resonali Voice Method is intended for adults.
 
The app is not directed to children under 13. A parent, guardian, clinician, or other responsible adult should determine whether any use by an older minor is appropriate and should provide supervision where needed.
 
6. Subscriptions and Purchases
Resonali Voice Method includes limited free content and may require an auto-renewable subscription to access the full activity library.
Available subscription options, prices, and billing periods are displayed in the app before purchase.
 
Payment is processed through the user’s Apple Account and the Apple App Store. Resonali LLC does not directly receive or store payment-card information.
Subscriptions automatically renew unless canceled through Apple before the end of the current subscription period.
 
Users may manage or cancel subscriptions through their Apple Account subscription settings.
Deleting the app does not automatically cancel an active subscription.
Purchases and refunds are subject to Apple’s applicable payment, subscription, and refund policies.
 
Resonali Voice Method does not currently offer a free trial unless one is explicitly displayed by Apple at the time of purchase.
 
7. Restoring Purchases
Users may use the Restore Purchases feature to ask Apple to verify eligible purchases associated with the Apple Account currently signed into the device.
Resonali LLC cannot manually create, transfer, cancel, refund, or alter an Apple subscription.
 
8. License and Apple Terms
Resonali Voice Method is licensed, not sold.
Use of the app is also subject to Apple’s Standard Licensed Application End User License Agreement and applicable App Store terms.

If these Terms of Use conflict with mandatory Apple App Store terms, the applicable Apple terms will control to the extent required.
 
9. Intellectual Property
Resonali Voice Method, including its written content, exercise structure, activity sequences, prompts, graphics, animation, design, branding, logos, software, and other materials, is owned by Resonali LLC or used with permission.
Except where permitted by law, users may not:

• Copy, reproduce, republish, or distribute app content

• Sell, sublicense, or commercially exploit app content

• Record and redistribute substantial portions of the app

• Reverse engineer, decompile, or attempt to extract the app’s source code

• Remove copyright, trademark, or ownership notices

• Represent Resonali materials as their own

• Use Resonali branding in a way that suggests endorsement or affiliation without written permission
   

Users may use the app’s activities for their own personal practice or, when legally and professionally appropriate, as a supporting tool during services they personally provide.
A subscription does not grant permission to reproduce or distribute Resonali materials as handouts, courses, downloads, recordings, products, or competing applications.
 
10. Professional Use
Clinicians and other professionals remain solely responsible for their own professional judgment, scope of practice, clinical decisions, documentation, informed consent, supervision, and compliance with applicable laws, regulations, licensing requirements, and professional standards.
The app does not direct or replace professional decision-making.
 
11. Privacy
Use of Resonali Voice Method is governed by the Resonali Voice Method Privacy Policy:

12. Availability and Changes
Resonali LLC may update, modify, add, remove, suspend, or discontinue app features or content.
Resonali LLC does not guarantee that every feature will remain available indefinitely or that the app will be uninterrupted or error-free.
 
Updates may be required to maintain compatibility, security, subscription access, or functionality.

13. Third-Party Services
The app relies on Apple services for downloading the app, processing purchases, managing subscriptions, and verifying purchase entitlements.
Resonali LLC is not responsible for interruptions, errors, account restrictions, payment decisions, or other actions controlled by Apple or another third-party service.
 
14. Disclaimer of Warranties
To the fullest extent permitted by applicable law, Resonali Voice Method is provided “as is” and “as available.”
 
Resonali LLC disclaims warranties not expressly provided in these Terms, including implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, and noninfringement.
 
Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to every user.
 
15. Limitation of Liability
To the fullest extent permitted by applicable law, Resonali LLC and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of, inability to use, or reliance on Resonali Voice Method.
 
This includes, without limitation, loss of data, loss of revenue, business interruption, vocal injury, physical injury, or decisions made based on app content, except where liability cannot legally be excluded.
 
Resonali LLC’s total liability arising from or related to the app will not exceed the amount paid by the user for access to Resonali Voice Method during the twelve months preceding the event giving rise to the claim, except where applicable law requires otherwise.
 
16. Indemnification
To the extent permitted by law, users agree to indemnify and hold harmless Resonali LLC and its owners, officers, employees, contractors, and affiliates from claims, losses, liabilities, damages, and expenses arising from misuse of the app, violation of these Terms, infringement of another person’s rights, or unlawful conduct.
 
17. Termination
Resonali LLC may suspend or terminate access to the app when reasonably necessary to address misuse, fraud, security concerns, legal requirements, or violations of these Terms.
Sections concerning intellectual property, disclaimers, limitations of liability, indemnification, and governing law will survive termination where applicable.
 
18. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
 
Any dispute will be handled in an appropriate state or federal court located in Florida, except where applicable consumer law requires another forum or procedure.
 
19. Changes to These Terms
Resonali LLC may update these Terms to reflect changes in the app, subscriptions, business practices, or legal requirements.
 
The effective date at the top of this page will be updated when material changes are made.
Continued use of the app following an update constitutes acceptance of the revised Terms to the extent permitted by law.
